Different legal ages for girls and boys to tie the Knot is a discriminatory practice . Legal voting age in India is 18 for both boys and girls but the legal marriageable age is 18 for girls and 21 for boys which indicates that more maturity and experience is required to handle a girl than to handle a country. When both boys and girls enter the schooling atmosphere at the same age and grow there till the age of 17 then how or why is it that girls are considered more mature and ready for marriage at 18 while the boys aren't? This law seems to be made by people who were mentally immature to understand the meaning of equality . Moreover, the reason behind the 3 years age difference is not known to anyone and definitely lacks scientific logic . The reasons cited by the majority of parents behind 18 years being set as the marriageable age for girls was poverty , fears about girls’ safety and a perceived lack of other options . This discriminatory practice of marrying girls at 18 years of age against boys who are marriageable at 21 has a far-reaching impact on the society and Nation as a whole . When girls are married off at 18 , it's the only life that they know.Just out of school and with very few employment prospects , they are dependent on their husbands (who themselves may not be professionally and financially independent at the age of 21 ). As a result, the girls are more vulnerable to abusive relationships as they have few options to leave and provide for themselves. Marriage is no joke and contrary to the popular belief , girls do not have enough maturity to get into a lifelong commitment at 18 years of age . They are often forced into these marriages by their parents .Their immaturity , lack of ability to take decisions and early pregnancy lead to frustrations, separation and divorce. Today, there are more opportunities , more choices, more knowledge and expectations from life which an 18 year old girl may not be able to avail as she is married off by her parents by that time. When the voting age can be reduced from 21 to 18 as done in 1988 , it’s time we amend the marriageable age in our country . Not only should it be increased to 25 but also kept same for both boys and girls as the regions of human brain which are crucial for decision making, anticipating consequences , rewards and risks do not reach maturity until 20s. Also, the boys become professionally and financially independent around the age of 25 years and hence can take on marital responsibility . As a progressive Nation, a new set of goals for national development are required with a desperate need to empower girls to prevent them from getting married at an early age as 18. They also need more time like boys to stand on their own feet . Once girls complete their education up to a minimum level of graduation or diploma , they have access to jobs that can earn them a living and help them in supporting their families . There is a need to remove this discrimination in terms of different legal marriageable age of boys and girls and provide them equal time and space to enter Matrimony . It’s time to embrace roles for girls beyond wedlock which will make them more responsible and financially independent.
Twinkle Khanna has been served with a notice for promoting Supertech Greater Noida project with 1400 flats which never took off and the developer has called it off. Maybe Mrs funny bones (Twinkle's recently acquired name) finds the matter funny and can laugh it off .However , it is a grave situation for those 1400 people who have invested their hard earned money in the project but have been left high and dry. Anupam Kher actively endorsed and advertised the project of Vigneshwara Developers which was abandoned by the company and when questioned over the same, he conveniently passed over the blame onto the gullible buyers , calling them 'funny'. Over the last few years, he has become self proclaimed spokesperson for Kashmiri Pandits and takes credit for turning on the spotlight on the plight of Kashmiri Pandits in the valley and says that had it not been for him, the present generation would not have known what happened to them 26years ago. But does Anupam Kher know what has happened to the buyers who had invested in Vigneshwara Developers, strongly endorsed and promoted by him? In one of his interviews, he has said that"The Kashmiri Pandits have been thrown out of their own land and I have a right to talk about their plight and suffering." But what about the plight and suffering of the large number of people who have been mislead by him? Why is he treating them differently? Is he not concerned about these homebuyers/investors who invested their life earnings in these projects because of the faith that he brought with his status? Is he not affected by the consequences of his association with a defaulter group or has the fee received by him sealed his lips? MS Dhoni, the most reliable and popular cricketer of our country, who was the Brand Ambassador of Amrapali Group, resigned from the builder who didn't deliver the houses to their buyers. But how has Dhoni helped these buyers by resigning? He only helped himself in doing so.Why has he not returned/refunded the payments received by him in this project? Many questions but no answers. Several homebuyers and investors have been hit hard by defaulting companies, false promises and incomplete projects endorsed by celebrities. It's high time for celebrities to take responsibility and bear the brunt of their actions in terms of a hefty penalty and jail term. Is Modi's promise of decriminalising politics , mere lip service or word of a Gentleman? “People never lie so much as after a hunt, during a war or before an election” said Otto Von Bismarck. In 2014 election campaign, Narendra Modi made an explicit promise that if he became the PM, “ No accused (with criminal charges) will dare to fight polls. Who says this cleansing is not possible?” Mr Modi has delivered enough and more lectures on the issue of eliminating political crime BUT one is bound to be suspicious when his actions do not match his words and the same was seen in the appointment of Keshav Prasad Maurya ( facing about a dozen criminal charges) as the president of BJP in UP. ‘Politics' is often called a 'dirty game' where there are no permanent friends/enemies, only permanent interests. Way back in June 2002, the political watchdog (election commission), on the direction of Supreme Court, issued an order that each candidate must submit an affidavit regarding the information on his/her criminal antecedents. But interestingly , at an ‘all-party meeting' reps of 21 political parties decided that the said order should not be allowed to be implemented, clearly upholding the Gospel truth ‘birds of a feather flock together' . Coming back to Mr Modi’s promise, in a recent report, Additional Solicitor General has said that recommendations of the ECI and the law commission, favouring lifetime disqualification of politicians with criminal cases against them, was under ‘ active consideration’ by the Centre. Also, the Centre has agreed to special courts to deal with cases against MPs and MLAs. With these special courts, an end is in sight to the inordinate delay in prosecuting politicians who have been sitting pretty in their positions for far too long. It’s time for the near and dear ones of such politicians (with criminal background/cases) to brace up and not die of shock like Lalu's sister who couldn’t bear the shock of his 3& 1/2 years jail sentence in a fodder scam case.
Adultery Law Biased Against Men A serving Brigadier of the Indian Army found guilty of committing adultery has been awarded 3 years RI and will also be cashiered from service while the consenting woman, who was an equal partner in the affair, got off Scot free. This recent incident once again raises the question , ' why is Sec 497 IPC biased against men?'What happened to to 'Gender Equality'? Wonder why no noise has been made by feminists who leave no opportunity and fight tooth and nail for 'equality' in status, rights and opportunities. A large number of groups, working in pursuit of gender equality, are mute on this issue where the man(adulterer) faces harsh and criminal punishment while the woman (adulteress) gets away without any punishment of equal nature and is rather shown as a victim. On 7Dec2017, the Supreme Court has agreed to re-examine the 157 yrs old law on adultery u/s 497 IPC which punishes men only. Sec 497 states ' whoever has sexual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivance of that man, such sexual intercourse not amounting to the offence of rape, is guilty of the offence of adultery, and shall be punished with imprisonment of either description for a term which may extend to 5 years, or with fine, or with both. In such case the wife shall not be punishable as an abettor.' The Supreme Court bench has said that 'Prima Facie, , sec 497 IPC grants relief to the woman (wife) by treating her as a victim'. But how/why is it that when adultery is committed by two consenting adults, one( male) is liable for criminal offence but the other (woman) is absolved? When a complaint is received from a man or woman that their spouse is involved in adultery, both the parties should be liable for equal consequences. Ordinarily, the criminal law proceeds on gender neutrality but it is missing in Sec 497 IPC which clearly discriminates against men and violates Article 14, 15 and 21 of our Constitution. The Supreme Court has issued notice to the Centre, seeking it's response in 4 weeks. It will be interesting to watch how and when the feminists will come out with their slogans and banners , demanding gender equality u/s 497 IPC also, which on the first view , is archaic and tantamounts to subordination of a woman when the Constitution confers equal status. YOUR HONOUR, DOES THE END JUSTIFY THE MEANS? In an unprecedented move which is rightfully being called a revolt, the 4 most senior judges of the Supreme Court of India, through a joint press conference on 12Jan2018, cast aspersions on the way in which cases are being selectively allocated to certain benches by the CJI. This insinuation , by these four judges, has created a storm not only in the judiciary but also in the minds of the citizens of this vast nation for whom the buck stops at the Apex Court , which for them, is the court of last resort and their faith vested in this supreme institution has undoubtedly taken a big hit. The charges levelled by these judges initially evoked disbelief and were criticized and frowned upon by one and all. However, the same has served as a catalyst for the CJI( the master of the roster) who is now trying to find ways to ensure transparency in allocation of cases. So, what's the way forward? What may be some of the ways to improve the administrative system in times to come? Well, while the 5 senior most judges may decide all the constitutional matters and CJI could reserve the right for keeping to himself hearing on certain extraordinarily important cases of national importance, other cases may be allocated through a computerized mechanism (to remove human element of favouritism) or based on the specialisation/years of experience in handling specific types of cases by the judges. And why not? In most other professions, there are areas of specialization, be it Medical, Teaching, Engineering , Defence Services . Without rule of law, it's not possible to fight corruption, poverty, disease and all other forms of injustice which are a hindrance in the development of a society. According to a survey of 1.1 lakh people across 113 countries, conducted by the World Justice Project, our country doesn't count among the most lawfully run countries (even seventy years after independence) and finds 66th place in this list. These rankings have been based on 8 parameters:curb on government power, absence of corruption, open government, fundamental rights, order and security, regulatory enforcement, civil justice and criminal justice. People of our country have immense faith in the Supreme Court of India and have extremely high respect for what this institution stands for. By washing dirty linen in public, these judges have achieved their target but at the same time, have planted a seed of doubt regarding the credibility of this supreme institution. "The Supreme Court's only armor is the cloak of public trust;its sole ammunition, the collective hopes of our society." Said Irving R.Kaufman. So once again, my lordships, does end justify the means?
